Derbyshire Constabulary Officer Jailed for Fatal Crash: What Happened

Ex-DCI Michael Cooper jailed for causing death by dangerous driving after blacking out at the wheel in Etwall, despite being told not to drive in 2009.

On Friday, former Derbyshire Police Detective Chief Inspector Michael Cooper was sentenced to three years and seven months in prison at Nottingham Crown Court. The 55-year-old pleaded guilty to causing death by dangerous driving and causing serious injury by dangerous driving following a crash in Etwall in September 2021 that killed educational psychologist James Bane, 50, and seriously injured a female colleague.

The case raises uncomfortable questions about accountability within police forces and the consequences when medical advice is ignored by those entrusted with public safety.

Derbyshire Constabulary Accountability

Cooper, who was on duty at the time, was driving an unmarked black Peugeot 208 without authorisation and without wearing his seatbelt. He had just left Etwall Leisure Centre when he blacked out at the wheel. Car data showed his foot was pressed on the accelerator as the car swung sideways.

Bane and his colleague, who cannot be named for legal reasons, had just left a nearby school and were standing near parked cars on Egginton Road. The impact threw Bane's companion into the air while Bane was crushed between two parked cars shunted together. He died at the scene from pelvic injuries.

After the collision, Cooper was confused. He told bystanders he was a painter and decorator and did not know who the prime minister was. In a subsequent police interview, he suggested he may have passed out but refused officers permission to access his medical records.

A Decade of Warnings Ignored

The court heard that Cooper had been told by a neurologist in 2009 to stop driving and inform the DVLA about past blackouts. He failed to do so. He also did not tell his employer, Derbyshire Police, or his insurance company about the medical advice.

Prosecutor Samuel Skinner KC described how Cooper had been on a phone call to his girlfriend just five seconds before the crash. The judge, Mr Justice Sweeting KC, called Bane's death a 'wholly avoidable tragedy' and said Cooper 'chose to run the risk' of blacking out.

The Human Cost

In a victim impact statement, Bane's widow described feeling 'trapped in this truly hideous no man’s land' for nearly five years while awaiting justice. Bane, a father of two teenage children, was an educational psychologist who devoted his professional life to helping children.

The case echoes other incidents where drivers with known medical conditions have continued to drive, with tragic results. It also highlights the particular responsibility of police officers, who are expected to uphold the law, not break it.

Accountability Questions

Cooper was using the unmarked police car without authorisation, treating it, as the court heard, like his own personal vehicle. The fact that a senior officer could drive an official car without proper checks raises questions about oversight within the Derbyshire Constabulary.

This case is not an isolated incident of police driving offences. In a separate case, former professional cyclist Rohan Dennis pleaded guilty to driving while disqualified in connection with the death of his wife, Olympic cyclist Melissa Hoskins. The pattern of individuals with known driving restrictions continuing to get behind the wheel is a persistent public safety issue.

The judge's sentence of three years and seven months reflects the seriousness of the offence, but for Bane's family, no sentence can undo the loss. The case serves as a stark reminder that medical advice about driving must be taken seriously, regardless of rank or profession.
